Probate
A Last Will and Testament is an instrument that provides for the transfer of property upon the death of the writer. While it may be unpleasant to think about our own passing, we know that it will take place sometime. A properly drafted will gives the writer many options to distribute their property. What you put in your will depends on what property you have, to whom you want it distributed, the dynamics of your family, and so forth. In the absence of a will, the laws of the State of Florida will determine who receives your assets. The probate procedure is not something that needs to be feared. Probate is the court-supervised legal process by which assets are gathered, applied to pay debts, and the expenses of administration, then distributed to those designated as beneficiaries in the will. The purpose of probate is to protect the assets of the deceased person and to carry out their written directions by passing ownership of their assets to a living person or institution. A Living Will which is sometimes referred to as a Health Care Directive is a written declaration that lets you state in advance your wishes about the use of life-prolonging medical care if you become seriously ill and unable to communicate. If you do not wish to burden your family with such difficult decisions, or the expense and prolonged grief involved in temporarily extending your life when there is no reasonable hope of revival, a living will typically authorizes withholding or turning off life-sustaining treatment if your condition is terminable. Some people mistakenly believe that a living will means that no medical treatment is allowed and that they may not be given medication for pain. This is not the case. A living will can state whatever your wishes are for or against any or all treatments, including pain management.
